Update on Status of Federal Vaccination Mandates (as of 8:30 am 11/22/21)

A federal judge has rejected Florida’s request to temporarily halt the implementation of the mandatory vaccination rules implemented by the Centers for Medicare and Medicaid Services. Accordingly, covered health care employers should be evaluating what to do in light of the conflict between Florida’s new vaccination law and the CMS rules.

As for the rules implemented by the Occupational Health and Safety Administration (“OSHA”), the halt placed on OSHA’s enforcement of the mandatory vaccination rules remains in effect – for now. Employers should be discussing internally what to do in the event that the Fifth Circuit Court of Appeal’s temporary injunction of the rule is overruled.
